Terms of Service

These Terms of Service (“Terms”) govern your use of Pointy, an online booking service operated by Eremin Roman (Hebrew: יריומין רומן), a sole proprietor registered in Israel (“Pointy”, “we”, “us”). By creating an account or booking through Pointy you agree to these Terms. If you do not agree, do not use the Service.

1. What Pointy is

Pointy is a platform that lets service providers (“Masters”) publish their availability and lets people (“Clients”) book appointments with them. Pointy itself does not provide the underlying services Masters offer, does not employ Masters, and is not a party to the appointment between a Master and a Client.

2. Eligibility and accounts

• You must be at least 16 years old to create a Pointy account.
• You agree to provide accurate information and keep it up to date.
• You are responsible for your account credentials and for all activity that happens under your account. Notify us promptly if you believe your account has been accessed without your permission.
• One person or legal entity per account. Do not share accounts.

3. How Masters use Pointy

If you create a Master account, you agree that:

• The services, prices, and availability you publish are accurate and you are legally entitled to offer them.
• You are solely responsible for delivering the services you accept bookings for and for any taxes, licences, or insurance that apply.
• You will handle Client personal data lawfully and only for the purpose of fulfilling the booking, as described in our Privacy Policy.
• Where a Client deletes their Pointy account and allows you to keep their name and phone number, you will delete those details if they later ask you to — directly or through privacy@pointy.me. Any notes you wrote about that Client are erased regardless of their choice, and you will not re-enter them.

4. How Clients use Pointy

If you book an appointment through Pointy you agree that:

• The booking details you submit are accurate.
• You will show up at the agreed time or cancel reasonably in advance.
• Any payment, refund, or cancellation arrangement is between you and the Master. Pointy does not process payments for the underlying service.

5. Acceptable use

You agree not to:

• Use Pointy for anything unlawful, fraudulent, or harmful.
• Impersonate another person or misrepresent your affiliation.
• Scrape, crawl, or otherwise extract data from the Service except as expressly allowed.
• Reverse engineer, probe, or interfere with the Service or its infrastructure.
• Upload content that is illegal, harassing, hateful, or infringes someone else's rights.
• Use Pointy to send spam or unsolicited messages to Clients.

6. Your content

You retain ownership of the content you publish on Pointy (your profile, services, availability, avatar). You grant Pointy a limited, non-exclusive, worldwide, royalty-free licence to host, display, and transmit that content for the sole purpose of operating the Service.

7. Pointy+: payment, renewal and cancellation

7.1 Plans and prices.The core Pointy features are free. Advanced features (“Pointy+”) are provided under a paid subscription. Current prices are published on pointy.me and in your dashboard; they are stated in New Israeli Shekels (₪) and include VAT where applicable. We may change prices; for existing subscribers the price locked at the first payment is kept for as long as the subscription continues without interruption.

7.2 Term and automatic renewal. A subscription runs for one month or one year and renews automatically for the same term, charged to the linked card (standing order), until you cancel it. Payments are processed by a licensed payment provider (Meshulam / Grow); Pointy never receives or stores card details.

7.3 Delivery of the service. Pointy+ is a digital service: access to the features is opened in your dashboard immediately after the payment is confirmed. We do not supply physical goods; nothing is shipped by post or courier.

7.4 Cancellation and refunds. You can cancel the subscription at any time in your dashboard (Settings → Plan) or by emailing privacy@pointy.me. Cancelling means the subscription will not renew: access to Pointy+ continues until the end of the period already paid for, after which the account moves to the free plan and your data and bookings stay in place. Because the service is delivered immediately and continuously, the fee for a period already paid is not refunded — except where a refund is required by mandatory law, including the Israeli Consumer Protection Law, 1981.

7.5 Age. Only a person aged 18 or over may purchase a paid subscription.

8. Third-party services

Pointy integrates with third-party services such as Google Calendar. Your use of those integrations is also subject to the third party's own terms and privacy policy. We are not responsible for the availability or behaviour of third-party services.

9. Suspension and termination

You can close your account at any time from the dashboard or by contacting us. We may suspend or terminate accounts that violate these Terms, that we reasonably believe pose a security or legal risk, or that have been inactive for an extended period. Where the law allows, we will give you reasonable notice and an opportunity to cure.

Sections that by their nature should survive termination — including disclaimers, limitations of liability, indemnity, and governing law — will survive.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Pointy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will not be lost.

Nothing in this section limits any mandatory consumer rights you have under applicable law, including EU and Israeli consumer protection law.

Content available through the Service — including master pages, service descriptions, assistant-generated texts and notifications — is not professional advice, a recommendation or an expert opinion, and reliance on it is at the user's own responsibility. Subject to Section 11 and to the maximum extent permitted by law, Pointy and/or anyone acting on its behalf are not liable for direct and/or indirect damage arising from use of the Service and/or of a service booked through it with a master, except as otherwise required by mandatory law.

11. Limitation of liability

To the maximum extent permitted by law, Pointy's aggregate liability arising out of or relating to the Service in any 12-month period is limited to the amount you paid us in that period, or one hundred US dollars (USD 100) if you paid nothing. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption.

Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold Pointy harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Changes to these Terms

We may update these Terms as the Service evolves. The effective date at the top reflects the latest version. For material changes we will notify Masters by email or via an in-product notice at least 14 days before the change takes effect. If you do not agree to the new Terms, you may close your account.

14. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. The competent courts of Tel Aviv-Yafo have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings in your local courts or under your local law, nothing in this section affects those rights.
